Terms & Conditions1. PricesAll prices are net and include VAT as indicated on the invoice. Shipping costs are not included in the sale prices. These, if applicable, will be calculated depending on the location of the wines (Stabio warehouse, Switzerland; Bordeaux; or León warehouse). Shipping costs will not be charged for orders over €1,500 if the stock is located in our León warehouse. AVU WINES SA reserves the right to amend its prices at any time.
2. PaymentsAll prices are net, and payment must be made upon receipt of the invoice and before collection/shipping. Exceptions may apply and will be expressly stated on the invoice. All invoices must be paid in full, including any bank charges that may be deducted. Late payments are subject to a 1% monthly interest fee. Interest charges will begin to accrue 15 days after the invoice date. Any applicable deduction will be invoiced. AVU WINES SA only accepts payments by bank transfer in Swiss francs or euros. Credit cards and cheques are not accepted. In case of non-payment or partial payment within the specified terms, AVU WINES SA reserves the right to cancel the order and charge a cancellation fee of 35% of the outstanding amount.
3. OwnershipAVU WINES SA retains ownership of the goods until full payment has been received. Collection or shipment of goods will not be permitted until full payment is made. Paid orders may be withheld in the event of overdue invoices until all outstanding amounts are settled.
4. Purchase OrdersPurchase orders may be placed in writing by email or any other electronic means. Verbal orders will be confirmed with an invoice. Any discrepancy must be reported to AVU WINES SA within 7 days. AVU WINES SA reserves the right to (i) cancel the order or (ii) adjust the prices in the event of payment delays or changes in taxes, duties, or shipping costs. No reminder or notice will be issued in the event of cancellation.
5. Collection and DeliveryThe Buyer must arrange collection of the ordered goods within 60 calendar days from the invoice date. After this period, and in accordance with AVU WINES SA’s general storage conditions, the wines will be stored in AVU WINES SA’s warehouse at the Buyer’s expense. A copy of the applicable storage terms is available upon request.
The Buyer may request AVU WINES SA to arrange delivery. In such cases, AVU WINES SA will assess the feasibility of delivery to the specified destination and provide a quote for the associated costs. All transport and delivery costs shall be borne exclusively by the Buyer.
AVU WINES SA may, at its sole discretion, engage a third-party carrier to handle the shipment and reserves the exclusive right to choose the logistics provider. In such cases, delivery shall be made entirely at the Buyer’s own risk and will be confirmed in writing.
Upon the Buyer’s request, AVU WINES SA may act solely as an intermediary in organising transport. However, AVU WINES SA accepts no liability for any failures, damages, delays or losses caused by the carrier during transit. In all cases, the applicable Incoterms shall be Ex Works (EXW), without exception.
If the Buyer requests insurance, the shipment will be covered by an “all risk” policy for the invoiced value, covering breakage, loss, damage or theft. Any damage must be reported immediately upon receipt of the goods. Although AVU WINES SA will assist in the claims process, it shall not be held liable for transport-related damages. Any refund or replacement will be processed only after the insurance company has accepted the claim and confirmed compensation.
5.1 In case of a dispute between the insurance company and the Buyer, AVU WINES SA shall act solely as a neutral intermediary and shall not advance or guarantee any refund or replacement if the insurance claim is rejected.
5.2 If the Buyer arranges their own transport, they shall bear full responsibility for the shipment, including arranging appropriate insurance coverage.
6. DeliveryUpon receipt of the goods, the Buyer must: 1. Check the conformity of the goods at the time of delivery. 2. Record any anomaly on the delivery note, clearly stating the reservation and including their signature. 3. Carriers do not allow goods to be returned once the package has been opened in their presence. However, the box may be inspected externally. If the box appears wet or damp, do not accept the delivery. Our logistics partner will notify us of the incident. AVU WINES SA accepts no liability for any consequences related to delivery delays.
7. Returns and Right of WithdrawalAny complaint regarding the products must be made within 7 days from the date of delivery.
The right of return does not apply if there is evidence that the products have been opened, handled, or exposed to unsuitable conditions. Products must be returned properly protected, in their original packaging, and in perfect condition for resale. No package will be accepted without sender identification (name, surname, address, order number).
Returned products will entitle the user to a full refund of the amounts paid. Return costs are borne by the user. This excludes returns due to our error or defective products.
In such cases, AVU WINES SA undertakes to replace the defective product with an identical one or refund the corresponding amount. AVU WINES SA will also cover the return and reshipping costs.
To initiate a return, please contact us by phone or by email at members@avu.wine. The user will receive a confirmation email acknowledging receipt of the return request. No exchanges or returns will be accepted unless AVU WINES SA has been previously notified.
8. Quality, Deficiencies and Notification of DefectsAVU WINES SA applies the appropriate wine storage procedures but shall not be held responsible for the condition or quality of the wines, or for whether such quality matches the expectations derived from the product description.
Any decision regarding compensation for a defect lies exclusively with the individual producers. AVU WINES SA undertakes to mediate with the producer on the client’s behalf.
Returns are subject to the condition that the defective bottle is returned with the original cork and ¾ of the wine intact. The return cost will be borne by the user.
9. Age RestrictionsBy placing an order with AVU WINES SA, the Buyer confirms that they are of the legal minimum age to purchase alcohol in their country of residence. If AVU WINES SA becomes aware that the Buyer is not legally permitted to purchase alcohol, it reserves the right to cancel the order immediately and without prior notice.
10. Governing LawAll contracts shall be governed by the relevant Spanish law, excluding private international law regulations.
11. JurisdictionThese General Terms and Conditions are governed and interpreted in accordance with the Spanish legislation in force at the time the contract is concluded. In the event of any dispute or claim between the parties regarding compliance with or the content of these General Terms and Conditions, and unless the jurisdiction of the consumer’s domicile applies by law, the matter shall be definitively resolved by submission to the Spanish Courts and Tribunals, or, at the discretion of AVU WINES SA, by submission to arbitration in law, administered by the Arbitration Court of the Official Chamber of Commerce and Industry of León, in accordance with its Rules in force at the date the arbitration request is filed.
The arbitral tribunal shall consist of a sole arbitrator, the arbitration shall be conducted in Spanish, and the seat of arbitration shall be León.
